Terms of Use

These Terms of Use ("Terms") govern your use of www.bgrowinc.com (the "Site"), operated by Bgrow Inc. ("Bgrow", "we", "us" or "our"). By accessing or using the Site you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Bgrow is a Pioneer® brand seed dealer serving Lambton County, Ontario, since 1998. The Site describes our products and services, shares resources and yield results for farmers and growers, and lets you request a quote. Information on the Site is general in nature and may change without notice.

You agree to use the Site only for lawful purposes and in line with these Terms. You must not:

• interfere with, disrupt or attempt to gain unauthorized access to the Site, our systems or other users' data;
• use automated tools such as bots or scrapers to copy content or overload the Site, except for ordinary search engine indexing;
• introduce malware or other harmful code;
• submit false, misleading or unlawful information; or
• use the Site or its content to build a competing product or to misrepresent your relationship with us.

The Resources and Yield Results pages share agronomy information, links to third-party tools and yield results to help growers plan their season. They are provided for general information only.

• Yield results are not a promise. They show how specific products performed in particular fields and seasons. Your results will depend on weather, soil, management and other factors. We update the yield results on the Site once a year. For current plot results, please visit Pioneer.com.
• Check before you decide. Product information, seed characteristics and recommendations may change. Before making decisions on seed selection, planting or crop protection, check the current product information and the label or bag tag, and speak with us or a qualified agronomist.
• Third-party content. Information such as cash bids, weather, news and field tools comes from other providers. It may be delayed, incomplete or temporarily unavailable, so check the original source before using it for marketing or trading decisions.

The Site, its design and the content we create (text, graphics, images and software) belong to Bgrow or our licensors and are protected by copyright, trademark and other laws. Product names, logos, yield data and documents from Pioneer (Vylor) and other third parties belong to those owners and are used with permission or for identification only. Pioneer® is a brand of Vylor.

You may view, download and print Site content for your own farm and internal business use. You may not sell, republish, modify or distribute our content, or remove any notices, without our written permission.

When you submit a form or message, you confirm that the information is accurate and that you have the right to share it. Submitting a quote request does not create a contract or reserve seed. Quotes, orders and agreements are separate and have their own terms.

The Site includes Gary, our AI website operator, which answers questions about our products, services and the information on the Site. Gary may produce incomplete or incorrect answers. Do not treat its responses as agronomic, professional, legal or contractual advice, or as a quote, price, availability or commitment. For anything important, confirm with our team.

We try to keep the Site accurate and up to date, but we do not promise that it is complete, current or free of errors. Figures and descriptions of yield, performance, price and availability are illustrative and based on our experience and on information from our suppliers. Actual outcomes depend on your farm and the season.

The Site links to third-party websites and tools, such as Pioneer and seed resources, grain bids, weather services and farm software. We do not control them and are not responsible for their content, accuracy or practices. A link is not an endorsement.

The Site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted or secure.

To the fullest extent permitted by law, Bgrow and its owners, employees and suppliers are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data or business, arising from your use of, or inability to use, the Site or its content. Our total liability for any claim relating to the Site is limited to $100 (Canadian dollars). Nothing in these Terms limits liability that cannot be limited by law.

You agree to defend and compensate Bgrow against claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

We may change the Site or these Terms at any time. We will post the updated Terms with a new "last updated" date, and your continued use means you accept them. We may suspend or end your access to the Site if you breach these Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts of Ontario for any dispute about the Site or these Terms.

If any part of these Terms is found to be unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. These Terms and the Privacy Policy are the whole agreement between you and us about the Site.
